Distance Sales Agreement

This Distance Sales Agreement (“Agreement”) is executed between the following parties in accordance with Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts:

1. Parties

  • Buyer: The individual or legal entity completing the purchase via www.mikrowizard.com

2. Subject of the Agreement

This Agreement regulates the mutual rights and obligations related to the sale, delivery, and use of the MikroWizard software license sold online by the Seller to the Buyer.

3. Product and Service Description

MikroWizard is a software-based digital license developed to manage and monitor MikroTik devices. The license is delivered electronically, assigned to the Buyer’s account, and sent via email in binary (.bin) format along with activation details.

4. Delivery Terms

The license is digitally delivered immediately after payment confirmation by assigning it to the Buyer’s account and sending an activation email. No physical delivery takes place.

5. Price and Payment

The product price and total payable amount are specified on the order confirmation page and invoice. Payment is processed by credit card, bank transfer, or other supported payment systems.

6. Right of Withdrawal

Pursuant to Article 15 of the Distance Contracts Regulation, the Buyer’s right of withdrawal is forfeited once the digital product is delivered and activated on their account/server. If the license has not yet been activated, the Buyer may exercise the right of withdrawal within 14 calendar days by notifying the Seller in writing.

7. Cancellation and Return

  • Unactivated licenses may be canceled or refunded within 14 days upon written request.
  • No return, refund, or cancellation is possible after the digital license file has been activated and delivered to the Buyer’s system.
  • Technical issues will be addressed via customer support, and if the issue remains unresolved, discretionary refunds may be considered by the Seller.

8. Obligations of the Parties

  • Seller: Deliver the license as promised, provide after-sales technical support, and ensure legal compliance.
  • Buyer: Provide accurate information, complete payment, and comply with license terms and EULA.

9. Data Protection

The Seller processes and protects Buyer’s personal data in accordance with Turkish Personal Data Protection Law (KVKK). Data will not be shared with third parties without consent, except as required by law.

10. Dispute Resolution

Any disputes arising from this Agreement shall be subject to the jurisdiction of Istanbul Consumer Arbitration Committees and Istanbul Courts and Enforcement Offices.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey.

12. Agreement Acceptance

By completing the online purchase process, the Buyer acknowledges that they have read, understood, and agreed to the terms of this Distance Sales Agreement, the Delivery and Return Policy, the EULA, and the Privacy Policy available on www.mikrowizard.com.
